Video: Civilians flee Aleppo as fighting intensifies

>> reporter: the government assault on aleppo is strangling the city. u.n. officials say some 200,000 people have fled aleppo in the last two days alone. syrian troops seemed determined to drive the rebels out of this city along with many of its 3 million residents. the rebels are trying to fight back. but the rebels aren't completely defenseless. they filled gas canisters with shrapnel to make their bombs more deadly then spread fertilizer on the floor and add aluminum powder. now it's a dangerous mix. as they fill the canisters with the explosive, tiny, combustible particles float in the air. one spark and it'll all go up. these are crude bombs but as rebel internet videos show they're powerful. yet it's civilians suffering the most here. we've seen government troops shelling civilian areas indiscriminately. this doctor is the only surgeon for 70,000 people. he's trying to stay neutral.

Latest Tea Party Vs. GOP Establishment Battle Comes Tuesday In Texas

One question heard over and over again this year: Is the Tea Party still relevant?

The question comes two years after it completely dominated the political conversation in 2010, when it was primarily responsible for defeating the Republican establishment in key Senate races such as in Florida (Marco Rubio over Charlie Crist), Kentucky (Rand Paul over Trey Grayson) and Utah (Mike Lee over Robert Bennett). In Pennsylvania, the Tea Party helped Pat Toomey end the GOP career (and Senate career) of Arlen Specter. In Wisconsin, it backed an unknown businessman, Ron Johnson, in his improbable victory over Russ Feingold. And it contributed scores of candidates, money and manpower in the Republicans' whopping net gain of 63 seats in the House.

There were some defeats, to be sure. They were blamed for throwing away all-but-certain Senate wins in Nevada, Colorado and Delaware, backing candidates (Sharron Angle, Ken Buck and Christine O'Donnell respectively) who won in the primary but fell far short of attracting enough Democratic and independent crossovers to win in November.

But when all was said and done, the Tea Party was instrumental in the big Republican victories of 2010.

This year, the scorecard is less clear-cut. They didn't come up with a winning Republican alternative to Mitt Romney, despite an endless tryout of wannabes. They did knock off six-term GOP Senate incumbent Dick Lugar in Indiana, but they failed to do the same to Orrin Hatch in Utah. (They will argue, with some justification, that their challenge to Hatch made him a much more reliable conservative.) And while they are pleased with the primary victory of state Sen. Deb Fischer in Nebraska, there were Tea Party activists who were behind the two losing GOP candidates, Jon Bruning and Don Stenberg.

One race that has clearly excited Tea Party activists is tomorrow's (Tuesday July 31) GOP primary runoff in Texas for the Senate seat of retiring Republican Kay Bailey Hutchison. Their candidate is Ted Cruz, the state's former solicitor general, who is being vastly outspent by his "establishment" opponent, Lt. Gov. David Dewhurst, who led Cruz by ten percentage points in the initial primary back in May.

Dewhurst is hardly a RINO; he is a longtime conservative who boasts the strong backing of Gov. Rick Perry and many leaders in the Lone Star State's GOP ranks. But the TP'ers insist Dewhurst, as president of the state Senate, is too eager to compromise with Democrats. He is also 66 years old, a quarter-century older than Cruz, and has spent nearly a decade in his current position ? hardly the 36 years both Lugar and Hatch have been in the Senate, but hardly the new face that Cruz represents.

Cruz, who has been compared favorably to Rubio ? both have parents who were born in Cuba ? is a dynamic debater who excites crowds wherever he goes. If Dewhurst has been getting the backing of a who's-who in Texas GOP circles, Cruz has been endorsed by a slew of national conservative figures, including Sarah Palin, Rick Santorum, Jim DeMint, Rand Paul, Sean Hannity and the Club for Growth. To paraphrase George Wallace, there may not be a dime's worth of difference between the two of them. But it's become the latest test of the Tea Party and its ability to take down members of the Republican establishment.

For the record, Democrats are also holding a runoff on the 31st, between ex-state Rep. Paul Sadler and retired educator Grady Yarbrough. But no Democrat has won a statewide race in Texas since 1994, and their last Senate winner came in 1988, when Lloyd Bentsen won his fourth and final term.

Still to come: the Aug. 7 Senate GOP primary in Missouri, where the Tea Party Express has endorsed former state Treasurer Sarah Steelman, and the Republican primary a week later in Wisconsin, where if nothing else the Tea Party wants to defeat frontrunner Tommy Thompson, a former governor.

Senate Ratings Update. Here is an update from my last "Battle for the Senate" ratings from back in January. Of the 33 Senate seats up for grabs, 23 are currently held by Democrats or Democratic-leaning independents. Only ten are held by Republicans. With Democrats currently holding a 53-47 advantage, the GOP would need four seats to take control ? or three, if they win the White House (and the VP would break a 50-50 tie).

The big change since my January ratings is in Maine. Back then, with the expectation that Olympia Snowe (R) would run again, I rated it "Republican Favored." With her retirement and the likelihood that former Gov. Angus King, an independent, will win, I'm moving it to "Expected GOP Loss." The further expectation is that King, should he be elected, will caucus with the Democrats.

Also, I've moved North Dakota, where Kent Conrad (D) is retiring, from "Expected Dem Loss" to "Tossup." And I've moved Florida, where Bill Nelson (D) is seeking re-election, from "Tossup" to "Democrat Favored."

Here are my ratings:

Debate sked. While we had this information back in October, it's now official. Last week the Commission on Presidential Debates announced the dates and locations of the three presidential (and one vice-presidential) debates to be held this fall:

vice-presidential ? Oct. 11 at Centre College in Danville, Ky.

2nd presidential (town-meeting format) ? Oct. 16 at Hofstra University in Hempstead, N.Y.

3rd presidential (foreign policy) ? Oct. 22 at Lynn University in Boca Raton, Fla.

Each debate will be 90 minutes long and have one moderator.

Q: You are being too nice in your review of "Political Animals" [see July 23 Political Junkie column]. I love Sigourney Weaver and eagerly awaited this new show, setting my DVR to record the series. But now, after seeing only two episodes, I've deleted the series. The odious buffoonish character of Bud is so off-putting and distracting, he renders the show unwatchable for me. A: I'm with you. As I wrote last week, I wanted to like it because (1) I too am a Sigourney Weaver fan, and (2) the topic ? a defeated female presidential candidate-turned-secretary of state ? looked like a promising theme for a TV series. But you're right. "Bud Hammond," the former president and caricature of Bill Clinton is done so clumsily, with lines written so painfully that, for me, it's nearly impossible to watch. Ciaran Hinds, the actor from Northern Ireland, may have some talent, but portraying Bud/Bill from North Carolina ain't one of them. No third episode for me.

Not that anyone asked me, but after five episodes of "The Newsroom," the HBO series starring Jeff Daniels about a cable news program and its suddenly opinionated anchor, I'm still trying to make up my mind. When the story line is about relationships between people inside and outside the network, or about the pressure of covering breaking news, it's fabulous. But I gotta tell you, it's getting a bit much being lectured by Aaron Sorkin time and time again about the Tea Party, Michele Bachmann, the Koch Brothers, etc. etc. etc. Yes, I get it, they're the bad guys. Fine. And I know exactly what Sorkin is trying to do by having the Daniels character be a registered Republican. (Hey, it's not liberal Aaron Sorkin bashing the right, it's a Republican!) Asking a Sorkin program not to be preachy may be asking for too much. But when it focuses on human drama, it's top notch.

Taiwan University Sues Apple Over Siri Patents

Taiwan?s National Cheng Kung University (NCKU) has sued Apple in a US court, accusing it of patent infringement in the design of the Siri voice recognition system, which is available on the iPhone and iPad.

The university is seeking an undisclosed amount of damages, based on the US sales of devices using Siri.

The NCKU, recognised by the Taiwanese Ministry of Education as one of the best universities in the country, filed a lawsuit in the United States District Court for the Eastern District of Texas, Marshall Division, on Friday. It focuses on two US patents dating from 2007 and 2010, related to voice-to-text technology.

Apple introduced the Siri voice command software with the launch of the iPhone 4S in 2011.

?We filed that lawsuit in the Texas court because it processes faster and its rulings are usually in favour of patent owners and the compensations are usually higher,? Yama Chen, legal manager of NCKU, told Reuters.

Chen said the University was also examining whether smartphone voice recognition systems used by Google?s Android and Microsoft?s Windows Phone 7 have infringed its intellectual property.

Earlier this month, the Shanghai Zhizhen Network Technology, based in China, had sued Apple, claiming the Silicon Valley company infringed on a voice technology patent owned by Zhizhen. The company said it had 100 million customers in China, many using Xiao i Robot ? a service similar to Siri.

Also in July, Apple had to pay $60 million (?38m) to Proview Technology, headquartered in Shenzhen, to settle a copyright dispute with the company that claimed the ownership of the Chinese ?IPAD? trademark.

Meanwhile, Samsung and Apple have entered the final stages of one of the most important, and expensive, patent disputes in the history of the smartphone market. If Samsung loses the case, it might find its whole Galaxy range banned from sale in the US.

Gabriel Omans wants to run faster, play harder, make the teammates in his youth baseball league proud. The 8-year-old Anniston boy has high hopes for next season: racing around the bases, running faster than people who used to leave him in the dust.

But at 4-foot-4 and 130 pounds, Gabriel is obese. His weight slows him down, his mother Lisa Omans says. It keeps him from running fast, Gabriel says.

?It keeps him back ? and I know it?s not healthy for him,? Lisa Omans, 47, said as she and Gabriel sat in the living room of their Anniston trailer on a recent morning. ?But he?ll eat and 10 minutes later, he?s like, ?I?m hungry! I?m hungry!??

It?s a struggle for Omans ? trying keep the pounds off her growing, omnivorous son. But she?s hoping that an Anniston pediatrician?s plans for a local children?s obesity clinic will help Gabriel get back to a healthier weight ? and help her learn techniques for keeping Gabriel fit in the process.

?I would love for my baseball players to see me be skinnier than last year,? Gabriel agreed. ?I would like to be shortstop.?

How It Works: Laser Beaming Recharges UAV in Flight

Tom Nugent likes to call his company?s current project a "wireless extension cord." Not a bad analogy for LaserMotive?s laser transmitter/receiver system, which recently beamed enough energy to a 17.5-pound drone to keep it airborne at least 48 hours?about 46 hours longer than the drone can usually fly.

The aircraft was Lockheed Martin?s Stalker unmanned aerial system (UAS). In June the defense giant held a private wind-tunnel test at LaserMotive?s Seattle-area home. Although the tech is in its early stages (it?s a technology demonstration, not yet a prototype), Nugent?s comparison proved correct: "You?re plugging a system into the wall, taking that electricity and converting it to light and transmitting that light through open air to a receiver, which converts the light back into electricity," Nugent says.

Manned fighter planes, the V-22 Osprey tiltrotor craft, and some helicopters can refuel in flight from tankers. But that technique isn?t practiced with gas-powered drones or with those that run on electricity, which have no choice but to land to recharge their batteries. A scaled-up version of the laser charger could keep aircraft aloft indefinitely.

The laser-transmitter demonstrator consists of a 3 x 6?foot optics table holding two gallium arsenide-based diode laser arrays. The laser arrays sit in boxes about half the size of a loaf of bread and shine into a set of lenses and mirrors. The lenses and mirrors shape and merge the laser beams and focus them into a gimbaled mirror, which in turn directs them toward a receiver.

For this test, the receiver was a thin photovoltaic panel attached to the bottom of the Stalker drone?s wing. The Stalker itself was mounted at the end of small wind tunnel where it remained in simulated flight two full days, its 9.5-foot wing positioned vertically to expose the photovoltaic panel to LaserMotive?s system as it beamed power to the receiver from 30 feet away.

The laser system can transfer only about 20 to 25 percent of the electricity it takes from its ground source. But drones like the Stalker don?t require enormous amounts of energy. In the June test, its battery held more energy after the test than when it began.

Most importantly, the ability to recharge an aircraft?s batteries in-flight offers big advantages, eliminating the need to make fuel stops that lose flight time and subject the plane to added risk, says program manager Tom Koonce of Lockheed?s famous Skunk Works in Palmdale, Calif. "A ground-to-air recharging system like this allows us to provide practically unlimited flight endurance to extend and expand the mission profiles that the Stalker vehicle can fulfill."

Nugent says the next step will be a proof-of-concept flight outdoors, though when and where hasn?t been announced. LaserMotive?s system includes computer software that uses video signals to keep the laser pointed at the receiver as the drone flies, and the company has already demonstrated that it can beam power to a receiver at least a kilometer away, which Nugent says is plenty of range to recharge a drone in flight. His company won a NASA Centennial Challenge Prize for beaming power that far in 2009. With larger optics and more expensive lasers, the system?s range could be extended to hundreds of kilometers in a straight line, but the Earth?s atmosphere would limit how far away a drone could be from its power source when flying at lower altitudes.

Laser power beaming is an idea that?s been around for years, but Nugent and his colleagues think its time has finally arrived, partly because of changes on the home front. The Federal Aviation Administration is in the process of loosening regulations that until recently have limited small UAV flying mainly to hobbyists. So providing a way to keep drones in the air more than a couple of hours could provide a major boost to an unmanned-aircraft market already poised to explode.

"Once people see that this capability exists, they?ll start thinking of ways to use it that we might not even consider," Nugent said. That?s why a colleague of his suggested a new slogan: "Think outside the battery."

FRANKFURT, Germany ? European Central Bank head Mario Draghi promised to do whatever it takes to save the European single currency and raised expectations that he could step in to lower the high borrowing costs that are crippling countries like Spain and Italy.

LONDON ? Global markets rallied after the European Central Bank's chief, Mario Draghi, vowed to save the 17-country euro from the financial crisis, possibly by intervening in markets to help weaker states like Spain.

Germany's DAX closed 2.8 percent higher while France's CAC 40 rose 4.1 percent. Britain's FTSE rose 1.4 percent.

TOKYO ? Japan's Nikkei 225 stock average climbed 0.9 percent and Hong Kong's Hang Seng added 0.1 percent. South Korea's Kospi gained 0.7 percent. Australia's benchmark rose 0.6 percent while the Shanghai Composite shed 0.4 percent.

South Korea's economic growth fell to a nearly three-year low in the second quarter as exports and capital expenditures shrank due to a slowdown in China and debt-saddled Europe, reinforcing views that the central bank will further reduce borrowing costs to prop up the economy.

Colorado Shooting Prompts Celebrity Debate Over Gun Control


While the country continues to mourn the losses incurred inside an Aurora, Colorado movie theater last week, and while new information continues to leak out about shooting James Holmes, a debate has also taken shape around America:

Considering the types of automatic weapons Holmes purchased legally, should the topic of gun control be more firmly addressed in light of the latest massacre?

Mayor Michael Bloomberg has made his feelings on the topic known, as have a number of celebrities.

In an interview over the weekend, rapper/actor Ice-T took expressed his take: “The right to bear arms is because it’s the last form of defense against tyranny... If somebody wants to kill people, they don’t need a gun to do it.”

He later Tweeted: “If you go into the jungle…. Will you NOT get eaten because you’re a vegan??”

Kids camp out in hospital as La Cueva teens recover | KRQE.com ...

Support continues to pour in for the two La Cueva high school cheerleaders who were badly hurt in a car crash Monday night.

Family members say Lilly Pickard and Jessica Sanchez are showing improvement everyday, but still have a long road ahead.

The 16-year-old girls were ejected from their SUV when it rolled on Paseo del Norte and Tramway. Neither girl was wearing a seat belt.

Lilly?s dad sent this picture of some La Cueva kids camped out at UNM Hospital in support of their classmates.

Philip Pickard says kids have been showing up at the hospital, setting up prayer meetings and a donation website.

A prayer vigil is set for the girls Sunday at 8 p.m. on the La Cueva High School soccer field.

So what does this change with regard to the old ways of doing things? When does an online relationship become ?intimate?? Can you fall in love with an avatar, and can you cheat on someone, or with someone, who is in a different time zone?

A recent study by Dr Martin Graff of the University of Glamorgan showed that our perceptions of what does and does not constitute ?cheating? online are affected by a variety of factors ? most prominently, and perhaps unsurprisingly, by the level of information dating site users are prepared to disclose about themselves; Dr Graff explains

?From this study, it seems that the greater the level of typed disclosure, then the stronger the perception of infidelity.?

Seemingly, in the absence of the ?nonverbal cues? on which face to face interaction relies so strongly, how much we are prepared to give away about ourselves is the primary indicator of how intimate our online relationships are and by extension, the degree of unfaithfulness inherent in the actions of non single site users.

Perhaps more surprisingly, the study also showed that the time of day at which online encounters took place was also a key factor in establishing infidelity, concluding that

?Exchanges later in the evening were perceived to be more infidelitous, than those which might ?? ?take place in the day or early evening.?

Dr Graff?s study is ongoing and subsequent phases will look at the issues of jealousy and trust in the0020context of online relationships.

Ultimately the jury is still out on exactly what constitutes online infidelity and indeed relationships over the net as a whole. It is doubtful that a firm conclusion will ever be reached as the world of online dating and relationships, as in ?real life?, will always be immensely subjective due to the differing moral standards and emotional responses of the individuals involved. Studies like Dr Graff?s can however provide a fascinating insight into the human causes and effects of the modern world, and how these are shaped by the direction of our rapidly developing and changing communications technology.

Syrian borders in rebel hands, battles in Damascus

AMMAN/CILVEGOZU, Turkey (Reuters) - Rebels seized control of sections of Syria's international borders and torched the main police headquarters in the heart of old Damascus, advancing relentlessly after the assassination of President Bashar al-Assad's closest lieutenants.

The battle for parts of the capital raged into the early hours of Friday, with corpses piled in the streets. In some neighbourhoods, residents said there were signs the government's presence was diminishing.

Officials in neighbouring Iraq confirmed that Syrian rebels were now in control of the Syrian side of the main Abu Kamal border checkpoint on the Euphrates River highway, one of the major trade routes across the Middle East.

Rebels also claimed control of at least two border crossings into Turkey at Bab al-Hawa and Jarablus, in what appeared to have been a coordinated campaign to seize Syria's frontiers.

In Damascus, a witness in the central old quarter district of Qanawat said the huge headquarters of the Damascus Province Police was black with smoke and abandoned after being torched and looted in a rebel attack.

"Three patrol cars came to the site and were hit by roadside bombs," said activist Abu Rateb by telephone. "I saw three bodies in one car. Others said dozens of security men and shabbiha (pro-Assad militia) lay dead or wounded along Khaled bin al-Walid street, before ambulances took them away."

The next few days will be critical in determining whether Assad's government can recover from the devastating blow of Wednesday's bombing, which wiped out much of Assad's command structure and destroyed his circle's aura of invulnerability.

Assad's powerful brother-in-law, his defence minister and a top general were killed in Wednesday's attack. The head of intelligence and the interior minister were wounded.

Government forces have responded by blasting at rebels in their own capital with helicopter gunships and artillery stationed in the mountains overlooking it.

Assad's failure to appear in public for more than 24 hours - he was finally shown on television on Thursday swearing in a replacement for his slain defence minister - added to the sense of his power evaporating. His whereabouts are not clear.

Diplomatic efforts - rapidly overtaken by events on the ground - collapsed in disarray on Thursday when Russia and China vetoed a U.N. Security Council resolution that would have imposed sanctions unless Syrian authorities halted violence. Washington said the council had "failed utterly."

Activists in Damascus said rebels were now in control of the capital's northern Barzeh district, where troops and armoured vehicles had pulled out.

The army had also pulled out of the towns of Tel and Dumair north of Damascus after taking heavy losses, they said. But they said troops were hitting the western district of Mezzeh with heavy machineguns and anti-aircraft guns overnight.

The reports could not be confirmed. The Syrian government restricts access by international journalists.

A resident who toured much of Damascus late on Thursday said he saw signs the government's presence was diminishing, with only sporadic checkpoints and tanks in place in some areas. The Interior Ministry at the main Marjeh Square had a fraction of its usual contingent of guards still in place.

Shelling could be heard on the southwestern suburb of Mouadamiyeh from hills overlooking the city where the Fourth Division, commanded by Assad's brother Maher, is based, he said.

Syrian television showed the bodies of about 20 men in T-shirts and jeans with weapons lying at their sides, sprawled across a road in the capital's Qaboun district. It described them as terrorists killed in battle.

COORDINATION

The operations to seize the border checkpoints appear to show a level of coordination and effectiveness hitherto unseen from the rebels, who have been outgunned and outnumbered by the army throughout the 16-month conflict.

Footage filmed by rebels at the Bab al-Hawa border crossing with Turkey showed them climbing onto rooftops and tearing up a poster of Assad.

"The crossing is under our control. They withdrew their armoured vehicles," said a rebel fighter who would only be identified as Ali, being treated for wounds on the Turkish side.

Two officers in the rebel Free Syrian Army said fighters were keeping themselves busy into the early hours of Friday, dismantling border computer systems, seizing security records and emptying the shelves of the duty-free shop.

At least 30 government tanks in the area had not mobilised to try to recapture the border post, according to Ahmad Zaidan, a senior Free Syrian Army commander.

Officials in neighbouring Lebanon said refugees were pouring across the frontier: a security source said 20,000 Syrians had crossed on Thursday.

UTTER FAILURE

Diplomacy has been largely ineffective throughout the crisis, with Western countries condemning Assad but showing no stomach for the sort of robust intervention that saw NATO bombers help blast Libya's Muammar Gaddafi from power last year.

Thursday's failed U.N. Security Council resolution, which would have extended a small, unarmed U.N. monitoring mission, was the third that has been vetoed by Russia and China.

With the mandate for the mission set to expire at 0400 GMT on Saturday, Western states that pushed the resolution to renew the operation under a threat of sanctions against Damascus reacted angrily to the vetoes.

The U.S. ambassador to the United Nations, Susan Rice, said the Security Council had "failed utterly", and Washington would look outside the body for ways "to bring pressure to bear on the Assad regime and to deliver assistance to those in need."

The Security Council was set for another showdown on Friday over new rival resolutions intended to simply extend the mission. Pakistan, with the support of Russia, is proposing a 45-day extension, while Britain has put forward a 30-day extension.

After negotiations late on Thursday, it was unclear if either measure had enough backing to pass - at least nine votes and no vetoes by the United States, Britain, France, Russia or China. The Security Council is scheduled to vote on Friday.

Report: Canada Looks to Archive Tweets, Other Social Media

There?s no Dewey Decimal system for the Internet, as Canadian archivists are discovering.

The Vancouver Sun reports that in an attempt to bring retrieval of all things Canadian to modern times, the Library and Archives Canada agency is looking for a way to archive tweets, blogs, and other online documents.

But it?s a difficult task.

"Any kind of historical record would be entirely incomplete without having some record of YouTube or the blogosphere or Twitter," Greg Elmer, director of the Centre for the Study of Social Media at Ryerson University in Toronto, told the Sun. "We simply don't have access to the means by which information is stored, indexed and formatted on YouTube or Twitter. It makes it an unreliable way of archiving information.?

Library and Archives Canada, the nation?s national library, houses nearly 3.2 million megabytes of information in electronic formats, as well as 21 million photographs, 270,000 hours of video and sound recordings, and much more.

In 2010, the U.S. Library of Congress announced it would archive every tweet since 2006 and onward, striking a deal with Twitter to receive all public tweets ever recorded. But U.S. officials admit it?s been a difficult project.

The hurdle of manually archiving the non-stop stream of online information is a modern problem, and most archival institutions have not yet caught up to modern technology, Elmer said.

Bedford, K-L School Leaders Oppose Proposed Change in Special ...

Local school districts are asking Gov. Cuomo to veto a bill proposing changes in the way special education placements are made because they say it will place financial and administrative burdens on schools.

Under the bill, passed by state lawmakers last month, schools would need to take a student's home life and cultural environment into account when making placement decisions. The measure would also speed up the process and require districts to reimburse parents for tuition payments made by parents to private schools not approved by the state within 30 days.

"It's essentially a voucher system we have no control over," said Jere Hochman, superintendent of Bedford Central Schools, at a recent school board meeting.

A group of 16 Westchester-Putnam school boards?including Bedford Central and Katonah Lewisboro Schools?have approved resolutions formally opposing the bill, which Gov. Cuomo has not signed into law.

Hochman said the change could cause public funds to be channeled to private schools because parents of students who are now fully included in public schools parents might opt for the private special education program that complies with the interpretation of considering 'home environment and family background.' The language could encourage more placements of students with low-incidence disabilities whose education can be in six figures, he added.

Assemblyman Robert Castelli (R-Goldens Bridge) said he supported the bill because it was the "right thing to do."

"I understand the financial plight of schools," he said. "But I do not think we are talking about more than a handful of kids. And this bill affords opportunities to kids who require specialized schooling and who have dietary and physiological needs beyond the public school setting. I sympathize with districts but at the end of the day, I sympathize more with the child."

The bill passed 47-13 in the Republican-controlled Senate and 93-50 in the Democratic-controlled Assembly on June 21, the last day of the Legislature's session this year, according to the Wall Street Journal.

Assembly Speaker Sheldon Silver said the costs were not a factor in developing the legislation. "We thought it was [about] fairness," he told the WSJ. "We honestly don't believe that it's going to cost school districts any more than is appropriate, than what's intended."

Assemblyman Tom Abinanti (D-Greenburgh) said he opposed the bill. "I think some of the ideas were right, but the way it's written is all wrong," he said.

Some supporters say the bill could actually save on local costs, with fewer placement hearings and drawn-out lawsuits when parents aren't satisfied with the services provided by districts.

Katonah attorney Peter Hoffman said he believed the bill, if passed, would cut down on the number of lawsuits brought by families given the new consideration for family life and cultural circumstances.

"I support the change because the current system leads to litigation that is
typically not completed until years after the actual school year in question
occurred," said Hoffman, whose practice focuses on children with disabilities.?

Abinanti argued the cost-saving measures for parents may be deceptive.

"The third part of the law is meant to speed up the placement process for children with special needs, which I think is a good thing," he said.

Current state law says that if a parent is dissatisfied with a child's public school or placement outside the district, the parent is responsible for paying for the student's new school until they receive a letter stating that the change has been approved.

"While that sounds good for lower and middle-class parents, what the law does not make clear is that if a parent's appeal is rejected, he or she is responsible for paying in full for the time the child spent in the other school," Abinanti said.
