Insights into primate diversity: Lessons from the rhesus macaque

ScienceDaily (June 29, 2012) ? New research published in BMC Genetics shows that the rhesus macaque has three times as much genetic variation as humans. However despite much of this extra variation within genes, protein function is not affected. Consequently damaging variations are at similar levels in macaques and humans -- indicating a strong selection pressure to maintain gene function regardless of mutation rate or population size.

Humans and rhesus macaques shared a common ancestor approximately 25 million years ago. Although there are now over seven billion humans on the planet only 100,000 years ago the human population was as low as one million. The effective human population, the number of people required to explain current genetic variation rate, was until recently less than 8,000.

The population size of rhesus macaques is in the millions and is exceeded only by humans (among primates). However there are 13 subspecies which have evolved to exploit environments as diverse as savannah and forests, and across a range of climate zones.

A team of researchers led by Christina Barr and David Goldman from the NIH determined that the effective population size for these primates was 80,000, ten times that of humans. Analysis of genetic variation, using single nucleotide polymorphisms (SNPs), showed that the macaque genome had three times higher genetic variation than humans. Most of these SNP were previously unknown and were disproportionally found in functionally important regions of DNA and each known gene had at least one SNP.

Dr. Goldman explained, "Although macaques have more variation than humans in the protein coding regions of genes, the ratio of variation in these regions compared to non-coding regions is significantly lower. Additionally the macaque variation is less likely to alter protein function. This brings down the amount of damaging variation to a level close to what was actually seen in humans."

Dr Barr continued "Our comparative approach across primate species (human and macaques) gives us a genomic view of evolutionary selection and reaffirms the effects of population history on genetic variation. Not very long ago, on an evolutionary timescale, there were more macaques than people, and the genomes of both species are a legacy of those times past."

Actor Don Grady of 'My Three Sons' dies at 68

Actor Don Grady died Wednesday at the age of 68. Grady passed away in L.A. after a long battle with cancer, his family confirmed to Deadline.

The actor was most well-known for his role as Robbie Douglas in "My Three Sons" and was one of the original Mouseketeers on "The Mickey Mouse Club." He joined the show when he was only 13 years old.

Grady landed his role on "My Three Sons" in 1960 and pursued a career in music when the show ended in 1972. He recorded an album with his collection of songs, "Homegrown," in 1973. In 2008, he released a collection of songs about the baby boomer generation, titled "Boomer."

San Francisco Mayor Mulls Stop-And-Frisk Policy To Reduce Crime

SAN FRANCISCO (CBS/AP) ? San Francisco Mayor Ed Lee said he?s considering implementation of the stop-and-frisk policy used in New York and Philadelphia to reduce crime.

In an interview with the San Francisco Chronicle editorial board on Wednesday, Lee said police officers need stop-and-frisk to get guns off the streets.

Civil rights groups have criticized stop-and-frisk as racial profiling, saying the policy disproportionately affects Hispanics and blacks. Thousands of demonstrators marched through New York?s streets in June to protest stop-and-frisk.

Lee is a former civil rights lawyer who doesn?t really want to bring stop-and-frisk to San Francisco, but he did say he would talk to New York Mayor Michael Bloomberg and others who have found those policies to be effective at curbing violent crime.

Although stop-and-frisk probably won?t happen in San Francisco, the rhetoric shows just how frustrated Lee has become with gun violence in the city.

Lee has stretched the debate with an attention-getting statement that shows he plans to get a lot tougher on crime by considering solutions that might lie outside San Francisco?s comfort zone.

Consider a recent sweep that saw 60 parolees and others on probation rounded up for various violations over the last couple of weeks, targeted enforcement that shares the same goal as stop-and-frisk.

Lee seems to be saying that jobs and summer programs aren?t enough to solve the problems of guns on the street, and is prodding San Francisco to consider unorthodox solutions.

Lee said he wants to explore the idea after discussing the policy with New York Mayor Michael Bloomberg.

Merkel rebuffs pleas for debt action on summit eve

BERLIN/MADRID (Reuters) - On the eve of an EU summit that could determine the future of the euro zone, German Chancellor Angela Merkel brushed aside increasingly shrill calls from Spain and Italy on Wednesday for emergency action to lower their soaring borrowing costs.

European Union leaders go into the two-day meeting on Thursday afternoon (1300 GMT) more openly divided than at any time since a still-widening debt crisis erupted in early 2010 after Greece had revealed its budget deficit and debt were far higher than reported.

Addressing parliament in Berlin, Merkel accused top EU officials of putting the cart before the horse by proposing common euro zone debt before EU controls are in place on national budgets and economic policies.

"I fear that at the summit we will talk too much about all these ideas for joint liability and too little about improved controls and structural measures," she said, renewing her mantra that even Europe's strongest economy must not be overburdened. Merkel left the door ajar to eventual joint debt issuance but offered no immediate moves to ease the crisis. By contrast, EU Economic and Monetary Affairs Commissioner Olli Rehn said European leaders would work at the summit on short-term steps to relieve market pressure on countries at risk.

"It is essential that (short-term policy measures) are decided by the European Council," Rehn told reporters.

The German leader insisted governments must commit to giving EU institutions the power to override their budgets and make them change policy before there could be any shared liability for Europe's debt.

"Joint liability can only happen when sufficient controls are in place," she said. The remarks appeared to be a less definitive rejection of common euro zone bonds than she made behind closed doors on Tuesday, when she told lawmakers she did not expect to see total shared debt liability in her lifetime.

Rome and Madrid have seen their borrowing costs spiral to a level which Spain at least could not afford for long as it tries to recapitalize banks ravaged by a property market collapse and cut a towering budget deficit.

Spanish Prime Minister Mariano Rajoy said he would ask other EU leaders to allow the bloc's bailout funds or the European Central Bank to stabilize financial markets.

Rajoy warned that Spain would not be able to finance itself indefinitely with 10-year bond yields near seven percent. "The most urgent issue is the one of financing. We can't keep funding ourselves for a long time at the prices we're currently funding ourselves," he told parliament.

DIVISIONS ON DISPLAY

EU divisions have been more openly displayed since Socialist Francois Hollande ousted Nicolas Sarkozy as French president, challenging Berlin to move away from austerity, promote economic growth and mutualise Europe's debts.

Rome and Madrid, now in the financial markets' firing line, have muscled into the traditional Franco-German axis.

Leaders of the four countries held an unusually discordant news conference in Rome on Friday and Merkel flew to Paris on Wednesday to try to repair the damage at a working dinner with Hollande. The four countries' finance ministers met late on Tuesday in Paris to try to narrow differences.

Merkel beamed at the media as Hollande greeted her warmly for talks that officials said would focus on bringing their long-term visions for European integration into line, as well as specific steps to ease short-term pressure on markets.

"I say we need more Europe and I think we are in agreement there," Merkel said. "We need a Europe that functions effectively, markets are looking for this, and a Europe where countries help each other."

Hollande - who put on a full guard of honor for Merkel after raising eyebrows in mid-June by quietly hosting German opposition leaders at the presidential palace - said they both wanted to deepen monetary union and bolster solidarity.

A conference call of all 17 euro zone finance ministers on Wednesday also focused on ideas to calm markets, such as altering the preferred creditor status of the bloc's future bailout fund, the European Stability Mechanism (ESM).

Berlin, which originally insisted that ESM loans must be senior to private bondholders to protect taxpayers from losses in any debt restructuring, hinted at flexibility on the rule, which has put investors off buying Spanish bonds.

A Eurogroup statement said the ministers welcomed Spain's request for assistance and expected it would need 51 billion-62 billion euros plus an additional "safety margin".

Ministers also welcomed an application made by Cyprus this week for help and said Nicosia would have to commit to budget cuts and structural economic reforms, as well as steps to strengthen its bloated financial sector.

The request made Cyprus the fifth euro state to seek aid from EU rescue funds, after Greece, Ireland, Portugal and Spain.

In Rome, Italian Prime Minister Mario Monti said on Tuesday he would not simply rubber stamp conclusions at the EU summit and was ready to go on negotiating into Sunday evening if necessary to agree on measures to calm markets.

With Hollande's support, Monti is pushing for the euro zone's rescue funds, backed by the ECB, to be used to bring down Spanish and Italian borrowing costs. Rajoy would settle for that or the ECB doing the same job by reviving its bond-buying program.

The proposal has run into stiff opposition from Germany, the bloc's effective paymaster, and has been rejected by Jens Weidmann, the powerful head of the German central bank.

Stock markets perked up last week on hopes that the 20th EU summit since the start of the crisis would come up with dramatic measures. Investors have since thought better of that view.

One senior euro zone source said there would be no short-term decisions for market consumption at the summit - no direct recapitalization of banks by the ESM, and no bond buying.

The euro fell on Wednesday, with many investors out of the markets before the Brussels meeting.

"People are waiting for the inevitable - which is that policymakers will probably fail to do what is necessary," said Neil Mellor, currency analyst at Bank of New York Mellon.

ECB chief economist Peter Praet gave markets some cheer by telling Financial Times Deutschland there was no doctrine that euro zone interest rates could not fall below the record low of 1 percent. It was the latest in a series of hints that the ECB may lower rates at its next meeting on July 5.

A Reuters poll showed 48 out of 71 economists expect the bank to cut rates next week. Respondents expect some progress towards a euro zone banking union at this week's summit but less advance on fiscal union.

BORROWING COSTS

Merkel finds herself in a dwindling minority in the EU, backed only by the Netherlands and Finland, but she holds the euro zone's purse strings and therefore nearly all the cards.

Italy and Spain argue that they are making wrenching sacrifices to cut their debt mountains and need some support from their currency area peers to keep the markets at bay.

Monti won a fourth and final confidence vote on Wednesday to accelerate passage of a watered-down labor reform criticized by both trade unions and the business establishment, strengthening his hand before the EU summit.

Spain, which has been offered loans of up to 100 billion euros to recapitalize its banks but is determined not to ask for a sovereign bailout, is considering raising consumer, energy and property taxes.

Underlining the parlous state of Spanish finances, figures showed the central government's deficit had already reached 3.41 percent of annual gross domestic product in only the first five months of the year, close to its target for the whole year of 3.5 percent.

Spain's central bank said it expected recession to deepen in the second quarter.

The Brussels summit is expected to agree on a growth package pushed by France worth around 130 billion euros ($162 billion) in infrastructure project bonds, reallocated regional aid funds and European Investment Bank loans.

The air tanker fleet tasked with the most dangerous mega-fire tasks ? think dropping tons of fire-retardant into remote and steep canyons?? is under?particular scrutiny. Pointing to the fleet?s decade-long decline?from some 44 tankers in 2002 to nine at the start of the 2012 fire season, one critic is calling the current situation an ?air tanker crisis.?

However Tom Tidwell, chief of the US Forest Service, one of four federal agencies charged with tackling fires and the one responsible for deploying the air tankers anywhere in the country, maintains that the state of preparedness is good, because the air tankers are only part of the overall mix of fire-fighting resources.

Mr. Tidwell points to some 300 helicopters and small planes that are also used, noting that?in the past decade, the mix?has shifted, with more?emphasis on the smaller craft. As a former firefighter, Tidwell says, ?the personnel on the ground really appreciate the helicopters because they can go places the large planes cannot.?

Nonetheless, he notes that?over the weekend, the?service sealed a deal with the US military to?deliver four tankers when needed. In addition, the Forest Service has assembled?eight other plane contracts, including several with the?Canadian government to bring the available tankers for this season to 21. Beyond that,?he points to additional?resources that have just been announced ? a contract for seven total?next-generation air tankers, three?to be delivered?by the?end of this year.

But those numbers don?t tell the whole story ? and they are too little, too late, says former wildland firefighter Bill Gabbert, founder of WildfireToday.com, a fire news blog. He points to numerous fatal crashes, two this year, attributable?in part?to aircraft age and metal fatigue.

?Eight of the nine planes in the core fleet today date back to the Korean War?era,? he points out, adding,??We are in a crisis.?

Tidwell suggests there is too much emphasis on the role of the air tanker in fire suppression, adding, ?there is this perception that tankers put out fires. But they don?t. Firefighters put out fires.?

Citizen science: Study allows thousands to test 'gut sense' for numbers

ScienceDaily (June 25, 2012) ? A first-of-its kind study using the World Wide Web to collect data from more than 10,000 study subjects ages 11 to 85 found that humans' inborn "number sense" improves during school years, declines during old age, and remains linked throughout the entire lifespan to academic mathematics achievement.

The study, led by psychologist Justin Halberda of The Johns Hopkins University and published in the online Early Edition of the Proceedings of the National Academy of Sciences during the week of June 25, is groundbreaking for presenting a picture of how our basic cognitive abilities may change across our lifetime.

"Gathering evidence from massive numbers of participants via the Internet the way we did is an important new model for doing psychological research," said Halberda, associate professor of psychological and brain sciences in the university's Krieger School of Arts and Sciences. "Engaging thousands of people between 11 and 85 years of age allowed us to generate a picture of how a core cognitive ability -- our gut sense for numbers, known as 'number sense' -- changes across a lifetime."

The term "number sense" is used to describe human and animals' inborn ability to intuitively size up the number of objects in their everyday environments. It's what enables a skittering squirrel, for example, to quickly ascertain which tree offers the most acorns, or a late-to-work motorist to figure out which E-Z Pass lane will get him on his way fastest. Scientists believe we are all born with this ability. They think it probably is an evolutionary adaptation that permitted our human and animal ancestors to survive in the wild.

In the study, everyday folks visited a website to play a simple game that tested their intuitive number sense by asking them to view screens displaying varying numbers of yellow or blue dots, and deciding rapidly which were more plentiful. (Readers can take the test themselves at www.panamath.com.) The test subjects also reported in detail about how they did in math class throughout their school years, and on the math portion of the SAT.

Previous research links school math ability with number sense in teenagers, but this study demonstrates that the relationship holds fast throughout the lifespan. Halberda and his team, however, were surprised to find that number sense peaks around the age of 30 -- almost a decade after other cognitive abilities reach their most acute.

"Perhaps most striking to us were the large developmental improvements that we found in people's gut number sense precision -- improvements that continued into the thirties," he said. "Either the maturing brain or the everyday activities people engage in helped improve the precision of their number sense throughout the first three decades of life."

These results suggest that a person's number sense is not set in stone, Halberda says, and may be improved by the things we do daily, such as deciding which grocery store checkout line has the fewest shoppers or which airport security line will move most quickly.

The fact that some people seem to be born with -- or to develop -- more acute number sense than others also has important implications educationally. The finding that number sense is, in a way, malleable leaves open the possibility of developing educational strategies to improve people's number sense, Halberda says.

The study was funded by the National Science Foundation and the Eunice Kennedy Shriver National Institute of Child Health and Human Development.

Lil Scrappy And Stevie J's 'Love & Hip-Hop' Fight 'A Real Situation'

Scrappy tells 'RapFix Live' about the drama, denying rumors the show is scripted.

You can expect the female cast of"Love & Hip Hop: Atlanta" to kick up some dust this season, but the guys get into their fair share of drama as well. A preview trailer for the rest of the upcoming season shows Lil Scrappy and record producer Stevie J. getting into a heated argument. Of course the tease is cut so we don't see much of the action, but the clip does show an agitated Scrap punching a wall after he and Stevie go nose-to-nose.

"It was a situation; it was a real situation," Scrap said when he appeared on "RapFix Live" on Wednesday.

According to Scrappy, the argument began after Stevie disrespected recurring castmember Erica, Scrappy's child's mother. The ATL MC feels that if Stevie had a problem with Erica, he should've bypassed her and addressed Scrappy instead. "Like I told him, you can walk off, you don't gotta disrespect no female," he said. "If you really wanna do something, ask her where her man at and tell him you wanna throw hands, you wanna take the fade, and I would've been happy to do that." Though Stevie and Scrappy are accomplished musicians and both now reside in the same city, Scrap says prior to the show neither he nor Erica had a personal connection to the multiplatinum producer, who has done work for the likes of Diddy, Jay-Z and Mariah Carey. "He didn't even ask — he didn't know who she was. All he knew is she was a part of the situation and he wanted to pop off," Scrappy said.

The "Money in the Bank" MC wouldn't give away the details of the fisticuffs, but he did shoot down whispers that he, his mother and his child's mother were following a script. "I don't know about the whole show and how [Stevie J.] do his end. I know my team Scrappy — we real on that side," he said.

(AP) ? Once again, a Washington Capitals leadership baton is passed from Dale Hunter to Adam Oates.

More than a decade after Oates followed Hunter as captain, a similar transition happened Tuesday when Oates was hired as the Capitals coach.

Except for one major exception: the one happened to fall on the same day Oates was elected to the Hockey Hall of Fame.

Even as he was joining Joe Sakic, Mats Sundin and Pavel Bure in the Hall, Oates joined Washington six weeks after Hunter's abrupt resignation. Hunter led the team to the second round of the playoffs as a midseason replacement before deciding he would rather be at home with his family, his farm and the junior club he owns in Canada.

So next up is Oates, 49, who played 19 seasons as a center in the NHL, including parts of six seasons with the Capitals from 1996-2002. His 290 assists rank 10th in team history, and he and Hunter were part of the 1997-98 team that made the only Stanley Cup finals appearance to date in franchise history.

When Hunter was traded in March 1999, Oates was selected as captain for the following season.

Oates, who will be formally introduced at a news conference Wednesday, has spent the last three seasons as an NHL assistant, first with the Tampa Bay Lightning before moving to the New Jersey Devils in 2010. He was part of the staff that helped lead the Devils to this year's Stanley Cup finals, which they lost to the Los Angeles Kings.

His most formidable task will be to develop a playing style that best suits a Capitals roster brimming with talent and that can also succeed in the playoffs. Led by Alex Ovechkin, Washington won four consecutive Southeast Division titles under offensive-minded coach Bruce Boudreau but couldn't advance beyond the second round of the postseason.

Boudreau was fired in November after an early-season slump and was replaced by the defense-first Hunter. Hunter eventually rallied the players enough to get them back in the playoffs but couldn't push them to the conference finals.

Oates played in the NHL from 1985-2004, appearing in 1,337 games while scoring 341 goals with 1,079 assists for Detroit, St. Louis, Boston, Washington, Philadelphia, Anaheim and Edmonton. Only Wayne Gretzky, Bobby Orr and Mario Lemieux have averaged more assists-per-game than Oates in the NHL history, and only Gretzky (662) had more assists than Oates (636) during the 1990s.

Oates is the fifth consecutive first-time NHL head coach hired by general manager George McPhee during McPhee's 15 years with the Capitals, following Bruce Cassidy, Glen Hanlon, Boudreau and Hunter.

"Adam was a highly intelligent player in the NHL for 19 seasons," McPhee said in a statement released by the club. "He has been an assistant coach in our conference for the past three seasons and is prepared to lead our club as head coach."

Facebook names 1st woman, Sandberg, to board

(AP) ? Facebook has named its No. 2 executive, Chief Operating Officer Sheryl Sandberg, to its board of directors.

Sandberg, who joined Facebook from Google in 2008, is the first woman on Facebook's board of directors. People had called for the company to add a woman to its board ahead of its initial public offering of stock in mid-May.

Sandberg, 42, joins CEO Mark Zuckerberg, Netflix chief Reed Hastings and entrepreneurs Marc Andreessen, James Breyer and Peter Thiel. Also on the board are Donald Graham, CEO of The Washington Post Co., and Erskine Bowles, president emeritus of the University of North Carolina system.

Sandberg's appointment is somewhat symbolic. Zuckerberg controls Facebook and its board through more than half of its voting stock.

It's among the most understated anti-war films ever made, effortlessly humanistic but far too subtle to indulge in preaching.

A model of simplicity and grace, with emotional effects that move you when you least expect it, the kind of great film that only a master can pull off.

A timeless classic of acting and filmmaking genius that uses the artificiality of war to explore the very construct of society, and is a classic must-see.

The great illusion is that these men of the officer class are somehow different from the masses who suffered the bloodiest of wars. Renoir proves that they are not.

A vividly humanist, anti-war classic.

A sorrowful, acutely thoughtful, and wholly imperishable masterpiece...

Google Said to Launch Virtual Server Cloud at I/O

Google is said to be introducing its very own cloud platform during the Google I/O developer conference to compete with similar offerings from Amazon and Microsoft.

That may sound strange at first since Google already has a cloud platform, App Engine. The difference is that Google will start offering virtual servers as opposed to an app platform, IaaS (Infrastructure as a Service) as opposed to Paas (platform as a service).

Amazon's Web Services for example allows developers to spun up virtual servers to suit their needs.

They don't actually get to run bare metal, though they can do that if they're willing to pay for it, but they get a machine or several to play with, for all intents and purposes.

They can choose from a number of available operating systems, several Linux distributions or Windows, and have complete freedom in the software configuration and what they're able to do with the servers.

Google's current cloud, on the other hand, enables developers to run applications, written in several programming languages though Python is prefered, and get all the resources they need, but they don't get access to the actual servers.

That's about to change, according to the rumor, Google will start renting virtual servers as well. It's going to interesting to watch as Google goes head to head with Amazon.

The latter has the IaaS market pretty nicely wrapped up and is a favorite of startups and companies or researchers on a budget. Google will also be able to compete with Amazon's storage service, S3, with its Cloud Storage service.

It remains to be seen what Google will announce, if anything, rumors don't always turn out to be accurate. But Google has usually reserved big announcements about its cloud platform for Google I/O so if the announcement is coming it's going to be there.

Oil near $91, up from 18-mth low; as Gulf storm builds

NEW YORK (Reuters) - Brent oil futures closed about 2 percent higher near $91 a barrel on Friday as it rebounded on bargain hunting after prices earlier fell to an 18-month low and U.S. crude futures rose in reaction to a potential storm in the Gulf of Mexico that could disrupt production.

An action by the European Central Bank to ease collateral requirements -- a move designed with Spain's woes in mind, caused the euro to rally against the U.S. dollar, supporting crude oil futures.

After falling about 4 percent on Thursday oil futures regained some composure as some buyers returned after the market had come under oversold conditions, analysts said.

Oil prices jumped back as "people were speculating that prices fell too far and they now represent a bargain," said Tim Evans, energy analyst at Citi Futures Perspective in New York.

In London, August Brent crude settled at $90.98 a barrel, gaining $2.75 to end a four-day losing streak. Earlier it slipped to a session low of $88.49, the lowest since December 2010, and then hit a session high of $91.70.

However, Brent crude fell for the week by $6.63, or 6.79 percent, the biggest weekly loss since the week to June 1.

U.S. August crude settled at $79.76, gaining $1.56, after rising to a session high of $80.37. It's low of $77.56 was the lowest since October 5, 2011, after dropping 4 percent on Thursday.

For the week, front-month U.S. crude fell $4.27, or 5.08 percent, also the biggest weekly loss since the week to June 1.

"The ECB's action will add liquidity to the system, and that is helping push up Brent futures. The oil markets are rebounding from oversold conditions, though investors are cautions because the market is well supplied," said Phil Flynn, an analyst at Price Futures Group in Chicago.

At the day's lows, Brent had fallen nearly $40 from the year's high of $128.40 hit in March. U.S crude had dropped $33 from its 2012 of $110.55 also struck in March.

In the Gulf of Mexico, the largest U.S. offshore oil port and Murphy Oil Corp. began evacuating non-essential personnel from their operations, ahead of a potential cyclone.

The news sparked more short-covering in late Friday trading.

The U.S. National Hurricane Center said a low pressure system in the Gulf, home to 20 percent of U.S. oil production and 6 percent of natural gas output, had a 70 percent chance of developing into a tropical cyclone over the next two days.

The Relative Strength Index, a closely watched technical signal, showed crude futures were oversold -- usually a sign that a rebound may be coming. For Brent, the index was near 25, after hitting 14 on Thursday. U.S. crude's RSI was at 31, after posting at 22 on Thursday. The 30 level is the threshold that indicates the onset of oversold conditions, which both contracts last began hitting in late May.

Reflecting investor caution, volumes were subdued, with Brent trading 4.2 percent below its 30-day average and U.S. crude down 10.4 percent also from its 30-day average.

Early on Friday, oil and other commodities and global equities came under pressure after the ratings agency Moody's downgraded the credit ratings of 15 of the world's biggest banks to reflect potential losses from volatile capital markets.

On Thursday, oil futures tumbled as data showed U.S. factory output grew at its slowest pace in 11 months in June, business activity across the euro zone shrank for a fifth straight month and Chinese manufacturing contracted for an eighth month.

While oil demand prospects are dimming, supply of oil remains ample. The Organization of the Petroleum Exporting Countries is pumping about 1.6 million barrels per day (bpd) more than the demand for its oil and its own supply target, OPEC figures show.

Much of the extra oil has come from top exporter Saudi Arabia, as well as from an export capacity expansion in Iraq and a recovery in Libyan output.

At its meeting last week, OPEC agreed to keep its oil output limit at 30 million bpd, with several members urging the Saudis to cut back supplies to reach the target.

"We are heading for a weak third and fourth quarter, so prices could go a lot weaker," said Leo Drollas, chief economist at the Centre for Global Energy Studies. "The Saudis at the end of the day will have to cut back themselves."

Amid the festering euro zone debt crisis, the leaders of Germany, France, Italy and Spain agreed on Friday on a 130 billion euros package in a bid to revive economic growth in Europe. However, they differed on whether to use euro bonds to ease the region's debt troubles.

American Crystal union workers locked out for nearly 11 months reject contract for third time

Locked-out union employees at American Crystal Sugar Co. rejected the company's contract proposal a third time Saturday.

The union announced that 63 percent of voters opted against the latest offer. It also said that 82 percent of the 1,300 union members that have been out of work for nearly a year took part in the vote.

"We know that give-and-take negotiations are the only way to get this cooperative back on track to productivity and profitability," the union statement said. "That cooperation has produced record profits in recent years, and, only through cooperating, will we be successful again."

A message left with American Crystal vice president Brian Ingulsrud was not immediately returned Saturday evening.

There was no statement immediately posted on the company's website about Saturday's vote.

The labor dispute, the company's first in 30 years, focuses on seniority and job security. Union employees said Crystal was out to break the union, while the company has said it offered a good contract with substantial increases in wages and benefits

American Crystal is the largest sugar beet processor in the country, with plants in North Dakota, Minnesota and Iowa. It's a cooperative owned by beet farmers.

The company has said it will continue to operate with replacement workers.

The company's original offer included a 17 percent wage increase over five years ? which is now closer to 14 percent because the contract had a deadline ? and increased pension, leave and vacation benefits. The union continued to demand wage and pension increases "significantly above" the final offer, company officials have said.

The union's first vote, held before the lockout, turned down the contract with a 96 percent "no" vote. The second vote in November was 90 percent against the deal.

After the last negotiating session on June 8, the union said that its principal objections revolve around health care, drug testing, seniority and qualifications for promotions. The union said the company made it clear in that meeting its not willing to compromise on any issue.

The union's statement Saturday also thanked "relatives, friends, neighbors and union sisters and brothers" for supporting the locked-out workers.

"Your strong support will continue to be needed as we strive to reach a fair resolution," the statement said.

After the June negotiating session, American Crystal said in a statement that the "parties remain far apart."

Fearing a strike in the middle of processing season, the company locked out workers on Aug. 1 and hired replacements. Company officials expect the plants to ramp up production in mid-August this year, earlier than normal because of a large sugar crop.

American Crystal has plants in East Grand Forks, Moorhead, Crookston and Chaska, Minn.; Hillsboro and Drayton, N.D.; and Mason City, Iowa.

Google Mistakenly Outs Android 4.1 In The Play Store, Galaxy Nexus To Be First Jelly Bean Phone

jellybeanWell isn't this interesting -- with just about five days to go until Google's I/O conference, the company may have just accidentally spilled the beans about their next big Android release. For a brief time, users who tried to purchase an unlocked Galaxy Nexus from the Google Play store was greeted by a blurb describing the device as the "the first phone with Android 4.1 Jelly Bean." Assuming this isn't just some random mistake Google has confirmed what nearly all of us expected their new update to be called, though there's sadly little other information to go on at this point.

Microsoft demos support for NFC-enabled ads, business cards in Windows Phone 8

Microsoft spent plenty of time talking about its NFC-based mobile wallet for Windows Phone 8 today, but it has more than just payments and loyalty cards in mind for the technology. It's also showed off how a Windows Phone 8 device can be used to scan NFC-enabled advertisements or business cards. In the case of ads, Microsoft's Joe Belfiore used a recent issue of Wired to demonstrate how you can simply tap an ad in a magazine and have content pushed straight to your phone -- something that could also be used with posters or other ads out in public. With NFC-enabled business cards, you'd have the ability to automatically import a person's contact information simply by taping their card to your phone which, incidentally, is something that can also be done directly between two Windows Phone 8 devices (a la Android Beam).

Kevin Costner is embroiled in another legal battle.?Earlier this month, he won a lawsuit against Stephen Baldwin over the right to British Petroleum's money versus breached bonds.?

This time, its Pacific vistas versus peeping paparazzi.

Charles "Rick" Grimm, the actor's neighbor at his beachfront Santa Barbara home, filed a suit for up to $500,000 Monday, alleging Costner breached a 55-year-old contract by planting hedges and trees taller than six feet, blocking the plaintiff's view of the Pacific Ocean, according to court documents obtained by The Wrap.

Costner allegedly broke a contract put into place when the property was initially subdivided back in 1957. That contract stipulated a six-foot limit to hedges.?

According to the documents, Costner planted 10-foot conifers to block the view of star-struck vacationers renting Grimm's house.?

Grimm, who claimed the obstruction devalues his house by half its original worth, wants the court to order Costner to prune the hedges back to the level of the six-foot, ivy-covered fence that divides their properties and to compensate him with $150,000.?

If not, he wants to be paid $500,000 in damages.?

Grimm, who owns an investment firm, claimed he spoke repeatedly to Costner's wife, Christine, who said they planted the evergreens to do "what we have to in order to feel comfortable in our own home."?

When Grimm confronted Costner a few more times about pruning the pine trees, Costner promised, but failed, to trim them, the documents allege.?

Then, in April, Costner planted at least nine tall Mexican fan palms, which Grimm expected will grow thicker and fuller, further obstructing his ocean view over time.?

"Costner stated he would not 'back down' on maintaining the hedge and palm trees as he prefers and that he will do everything in his power to secure his privacy," the documents state.?

The contract was put in place when subdivider Elsie S. Holloway divvied up what became known as the Holloway Tract. Owners of the newly parceled oceanfront properties signed Holloway's declaration stating "no wall, fence or hedge shall exceed six (6) feet in height."?

A spokesperson for Costner did not immediately respond to a request for comment.
