DUBAI, United Arab Emirates (AP) ? It was a VIP audience for what was likely the last performance of the venerable Tehran Symphony Orchestra. Watching from the front row in late August was Supreme Leader Ayatollah Ali Khamenei in what was seen as an endorsement from the ruling theocracy, which once tried to stamp out all music as a violation of Islamic values.

Just two months later, the musicians are out of work, funding has run dry and a nearly 80-year-old institution that survived wars, coups and the 1979 Islamic Revolution was declared Tuesday in an apparently irreversible "coma" by media.

The apparent tipping point was financial. It could be counted as collateral damage from Western sanctions that have left Iran's economy so stressed that authorities are considering banning exports of staples such as rice and wheat in order to boost emergency stockpiles.

"We are currently facing a financial drought," Parliament speaker Ali Larijani told a group of officials Monday. "We will have a more difficult year ahead."

The full story of the orchestra's demise likely runs deeper. In a time of escalating showdowns with the West over Iran's suspect nuclear program, the opposition of Iran's clerical leadership toward anything deemed as too Western is gaining strength.

"Musicians have had no support in recent years," said Saba Radman, a music journalist and critic. "They feel very disillusioned."

The Tehran orchestra ? by far the oldest and biggest of several concert hall-style ensembles in Iran ? was often an easy target of hard-liners because of its roots during the era of the Western-backed monarchy toppled by the Islamic Revolution. During its heyday in the 1960s and 70s, it hosted performances by world famous musicians such as violin virtuoso Yehudi Menuhin.

The orchestra fell further from favor during a European tour after the riots triggered by President Mahmoud Ahmadinejad's disputed re-election in 2009. Opposition supporters in Europe used the concerts as forums to denounce Iran's ruling system and flash the green wrist bands and scarves that symbolized the protest movement.

Meanwhile, Islamic conservatives ? including forces within the powerful Revolutionary Guard ? have reclaimed influence since the widespread crackdowns on reformists and can even exert muscle over Supreme Leader Khamenei. Cultural groups outside direct state control, such as the Tehran orchestra, have often come under suspicion as potential liberal-leaning havens. In January, authorities closed down the House of Cinema, an independent film group that operated for 20 years.

"Many concerts have been canceled by local authorities over the past years, but the Culture Ministry raised no objections," said Radman.

Hamid Shahabadi, the deputy culture minister in charge of artistic affairs, acknowledged some delays in payments for musicians while insisting that the orchestra has not been disbanded, but he indicated that its musicians need to look for work elsewhere.

He suggested some could be absorbed into a planned state-run institution that would oversee all remaining orchestras. Those concentrate heavily on traditional Persian music.

Iran's Islamic authorities tried to ban all music in the early years of the Islamic Revolution, claiming it violated strict Muslim tenets. The clerics eventually relented, but, as recently as 2005, Ahmadinejad tried unsuccessfully to outlaw Western music on state-run television and radio.

At the same time, the Tehran Orchestra performed Beethoven's Symphony No. 9 ? drawing criticism from some conservatives because the piece was associated with liberals and secular groups during the early years of the Islamic Revolution.

A year later, it brought more grimaces from Islamic authorities for its program in Germany that included Tchaikovsky's Overture to "Romeo and Juliet" and Beethoven's Seventh Symphony ? with a snippet of "Dog Breath Variations" by American rock impresario Frank Zappa slipped in.

In late August, the orchestra may have played its last piece ? the Iranian national anthem ? at the opening of the Nonaligned Movement summit, which Iranian officials billed as a world gathering to challenge the economic pressures of the West over Tehran's nuclear program.

Orchestra members told the semiofficial ILNA news agency Monday that they have not rehearsed together or been paid for three months. An experienced musician may receive just 6 million rials, or less than $200 a month at the current exchange rates ? below an average taxi driver's pay ? and must supplement income through other performances or professions.

"Many (Iranian) artists are working as taxi drivers, office secretaries and accountants" rather than focusing on their profession, singer Fazel Jamshidi was quoted by the semiofficial Mehr news agency.

Arsalan Kamkar, a violinist in the orchestra, told The Associated Press on Monday that "only seven or eight members of the orchestra have valid contracts. Unfortunately, the rest have not had contracts over the past months, and it seems unlikely their contracts will be extended."

Kamkar said the shutdown highlights the dislike for Western-oriented culture by Iran's rulers, who are also sitting on one of the world's prized collections of European and American modern art.

In August, the Museum of Contemporary Art displayed about 100 works purchased by the late shah and his family ? including pieces by Andy Warhol, David Hockney and Jasper Johns. But most of the collection ? works by Picasso, Jackson Pollock, Francis Bacon and many others ? remains in vaults and basement storage.

Google's Vic Gundotra is posting pics with the Nexus 10 tablet

It's not unusual to see top-level Googlers vacationing in some really cool places. It's also not unusual to see them taking pictures with unannounced devices.

So here's Google senior VP of engineering Vic Gundotra on a beach with a Samsung Nexus 10, as posted on Google+. It's shot at 2048x1536 -- or 3.1MP -- resolution (which seems low and likely is a G+ resize, especially given that these pics look pretty darn good), and the camera type clearly says "Nexus 10." (That can be manipulated, of course. But c'mon, would Uncle Vic really troll us?)

The Samsung Nexus 10 is one of two devices we expect to be announced Monday at Google's "The Playground is Open" event in New York City, the other being the LG Nexus 4. (Remember to keep it locked here Monday morning -- we'll be covering it live!)

Customers like to know what to expect, so if you?re a one man band then let them know why that works so well for you, or if you?re a small business with plans to grow then let your customers know that they are part of that.

Google launches Docs, Sheets, and Slides apps in the Chrome Web Store

Earlier this year Google folded its online office suite into the Google Drive online storage service. Now when you type docs.google.com into a web browser, you get redirected to drive.google.com.

But this week Google made it a bit easier to create new text, spreadsheet, or presentation documents with a single-click. The company has released a series of new web apps int he Chrome Web Store which lets you add the shortcuts to your Chrome web browser or Chrome OS device.

Google Docs

You?ll still need to launch Google Drive if you want to see a full list of your existing documents or other files. But if you want the shortcuts for specific office apps, you can find them in the Chrome Web Store:

Aside from quick-launch shortcuts, the new Chrome apps don?t add any real features to Google?s online office suite. But if you?re thinking of picking up one of those new $249 Chromebooks, it might be nice to be able to ?install? shortcuts that let you create new documents quickly.

A Brazilian woman has sold her virginity for $780,000 in an online auction organised by a Melbourne filmmaker.

Catarina Migliorini, a 20-year-old physical exercise student, had volunteered to sell her virginity as part of a documentary by Justin Sisely.

Last night the auction was reportedly finalised with a Japanese man, identified only by the name Natsu, agreeing to pay $780,000.

Mr Sisely told ninemsn that Ms Migliorini is ecstatic about the sale and had not expected this amount of interest.

?The auction closed at 10pm last night and Catarina is extremely excited. She was speaking to her family in Brazil online, and they were extremely happy for her,? he said.

?But I guess they didn?t expect her to do something like this.?

The winner, Natsu, fended off strong competition from American bidders Jack Miller and Jack Right as well as an Indian national, Rudra Chatterjee.

Ms Migliorini has come under fire after news of the auction made headlines, with many likening the sale to prostitution.

?If you do it once in your life than you are not a prostitute, just like if you take one amazing photograph it does not automatically make you a photographer,? she said.

Ada County toddler killed because baby sitter wanted to play Xbox ...

Prosecutors told an Ada County jury Tuesday that 18-month-old Alaija Corbin had fresh injuries to her feet, ankles and shins the same night she suffered a fatal head wound. They also said the toddler was shaken with such force that she had fresh tissue damage injuries under her arms. But the worst injury was to Alaija?s head, which led to her dying a week later.

Prosecutors say all those injuries were caused by 22-year-old Jordan Everhart as he watched the toddler on Oct. 7, 2011, while her mother worked a double shift. Prosecutors told the jury that Everhart was angry because the toddler wouldn?t go to sleep.

?Alaija Corbin was beaten and murdered because her mother?s boyfriend? wanted to play video games, Ada County deputy prosecutor Jill Longhurst told the jury during opening arguments in Everhart?s first-degree murder trial. ?She wouldn?t go to bed, and she wouldn?t leave him alone. And wouldn?t let him play his Xbox.

?He struck her repeatedly, across the tops of her toes, the tops of her feet, across her ankles and even her shins.?

Longhurst didn?t tell the jury how authorities suspect the toddler got her fatal brain injury, but did say forensic tests will show that the toddler was hit by a solid object hard enough to cause a fatal brain injury.

Longhurst said that when Everhart figured out the toddler was badly hurt, he first called his mom for advice and then called the girl?s mother at work ? before he called 911.

Paramedics found the toddler unconscious and clad in a diaper on the floor of a trailer home in the 300 block of East 40th Street about 2:30 a.m. on Oct. 8, 2011. When asked by a firefighter what happened, Everhart said the toddler fell backward and hit her head. Everhart had told 911 dispatchers that a dog knocked down the toddler, Longhurst said.

Paramedics took Alaija to St. Luke?s Boise Medical Center, where she eventually died.

Defense attorney Gus Cahill told the jury Monday that Everhart is ?accused of committing a murder he didn?t commit? and said the evidence prosecutors have does not support a murder charge.

Cahill did not provide the jury an explanation for how Alaija got her injuries, but he said that many of the witnesses expected to testify against Everhart created a narrative ?after the fact.?

Cahill also told the jury that Everhart was still dealing with injuries he sustained in a house fire years before and questioned whether Everhart had the physical strength to cause the toddler?s injuries.

Cahill also said that Everhart called his mom for advice when he discovered Alaija was injured because his mom was a nurse.

Testimony in the case is expected to last for several weeks.

Longhurst told the jury that the state?s case would be made up of two parts ? a lot of testimony about the injuries the girl suffered and how those happened, and then testimony from family and friends about how the toddler was healthy and happy the last time she was seen by anybody else before she was fatally injured.

Everhart could be sent to prison for life if the jury finds him guilty of first-degree murder.

Jury mulls suit against energy co-op

'); }// end if A Des Moines County jury deliberated for three hours Monday without determining whether an area energy co-operative's electrical distribution system caused in excess of $8 million in damages to a New London dairy.

The jury will resume deliberations at 9 a.m. today in the lawsuit brought by Dalarna Farms against Access Energy Cooperative, saying the company's electrical distribution system led to "low milk production and a high death rate" in the farm's dairy herd.

The three-week jury trial before District Judge Mary Ann Brown ended Friday following testimony from 22 witnesses, including more than 15 expert witnesses and 335 exhibits.

"This case is a big deal to both the dairy industry and the energy industry," Scott Lawrence, the attorney representing Dalarna's California owners told the jury in closing arguments. "This type of case is aimed at altering public policy on how energy companies respond to the issue of electricity distribution."

However, Stuart Mondschein, the co-op's attorney, told the jury there are more plausible reasons why the animals became distressed or died, including bad nutrition, infectious diseases, environmental issues, the farm's financial problems and the dairy operator's inexperience in running a Midwest dairy farm.

"Access Energy did not cause any of these problems," he told the jury during a three-hour summation by opposing attorneys. "This case is about the business of how milk is made in a factory-style setting. ... This is also a case about human nature."

Testimony during the trial indicated hundreds of lawsuits have been filed across the United States since the mid-1980s related to stray voltage's impact on dairy farms.

Experts testified "stray voltage" occurs when a farm animal makes contact with metal equipment electrified by minimal currents in the ground.

Both Lawrence and Mondschein, who have been opposite each other in cases similar to this across the Midwest, cautioned the jury not to be overwhelmed by the scientific evidence presented.

"How do you decide a case like this after three weeks of highly technical testimony?" Mondschein asked the jury. "You look for the credibility of the witnesses. Who has an interest in the outcome? What is their bias?"

Lawrence agreed the case has been technical, but said it comes down to the jury using its ability to determine what is right from wrong.

"Yes, we have had complex expert testimony but ultimately justice comes from the community, not from the experts," he said.

Dalarna claimed "stray voltage" from the distribution system supplying the energy to the dairy operation mildly shocked the herd through milking machines and tanks used to feed and water the herd.

Lawrence said when Dalarna's owners approached the cooperative about changing the way energy was being supplied to the dairy, Access scoffed at the request.

"Access Energy's response was that there was not a problem with its (electrical) current system," Lawrence said. "Access Energy said 'we do not agree we are the cause' to any harm to your farm. I submit there was a lot of harm here. Putting a dairy farm out of business is a big deal."

However, Mondschein said Access Energy's system is accepted nationwide.

"The multiple grounded system Access Energy uses is overwhelmingly accepted across the United States," he said. "It is a very safe system."

Mondschein told the jury what actually happened to Dalarna was a combination of problems, including the fact Steven Carlson, a California veterinarian hired to run the dairy, did not understand the differences in operating a dairies in California and Iowa.

Mondschein cited environmental differences, including the climate. He said when Carlson began to experience major problems in the herd, he looked to the "stray voltage" as the only reason.

"People will see what they want to see," he said. "Dr. Carlson had no experience in dairying in the Midwest. He was from California. He had never done what he was being asked to do here.

"He got an idea in his mind that 'stray voltage' was causing the problem and he never let go of that. ... There is no accurate data to prove their case. ... To measure 'stray voltage' you've got to use the right equipment in the right way."

However, Lawrence said evidence presented did not indicate it was Carlson's skills or other issues raised by the defense. Instead, he said it was the co-operative's decision to do nothing to change the electrical system specifically causing problems at the New London dairy.

He said Access Energy did not want to address the issue of "stray voltage" at Dalarna because energy companies want a uniform distribution system across the nation for economic reasons.

"Access Energy's approach was unfortunately typical of this industry," he told the jury. "You need to make companies (like Access Energy) stand up and take responsibility."

Mondschein told the jury the best way it could do that was to find Access Energy did nothing wrong.

"I think the best thing you can do is send everybody out of this courtroom the way they came in," he said, indicating they should find Access Energy was not responsible for any damages that occurred at the dairy. "That is your responsibility."

Tunisian man may be first break in Benghazi attack

One of the first clues the intelligence community had about the perpetrators of the Sept. 11 assault on the U.S. consulate in Benghazi was when a Tunisian national posted an update on social media about the fighting shortly after it had begun.

The post from Ali Ani al-Harzi, who is now suspected of participating in the attacks, was what helped U.S. intelligence locate him and track him down after he fled Libya for Turkey, according to four U.S. officials familiar with the unfolding investigation.

These people say Turkish officials held al-Harzi for less than a week at the behest of the U.S. government, then sent him to Tunisia. There, he was kept in military custody until last week, when he was transferred to a jail in preparation for a court trial. It?s unclear what role he might have played in the attacks or what he might be charged with. The Federal Bureau of Investigation and the U.S. intelligence community are working with Tunisian authorities, but there has been no deal yet on whether to send al-Harzi to the U.S. or keep him in Tunisia where he could be charged under the country?s own counterterrorism laws. The Tunisians have also not yet allowed U.S. officials direct access to the suspect.

Al-Harzi is a member of violent extremist networks in North Africa, one U.S. intelligence officer told The Daily Beast. This person added that he was also connected to jihadist organizations in the Middle East and was headed to Syria when he was detained in Turkey.?

The investigation into what happened on the 11th anniversary of Sept. 11 in Benghazi is complicated by a number of factors. It?s an election season, and Republicans have accused Democrats of trying to cover up a terrorist attack and misleading the public. Democrats have countered that Republicans and Mitt Romney have attempted to politicize a national tragedy.

The latest CIA view of the attack sent Friday to Congress says the attack on 9/11 was ?opportunistic? rather than being planned days or weeks in advance. This assessment is based in part on a review of intercepts collected before 9/11 in and around Benghazi. A U.S. intelligence official told The Daily Beast that the review of collected intelligence found ?there was nothing that would have given us some indication that an attack was being planned or imminent.?

This resonates with what James Clapper, the director of national intelligence, said earlier this month at an intelligence conference in Orlando known as GEOINT: ?If people do not emit or discuss their behavior, it's hard to find out what they are going to do.?

The CIA?s latest assessment also says once and for all that the assault didn?t start as a protest against an anti-Islam Internet video. In the first eight days following the attacks, the Obama administration cited that video as the primary cause of the assault.

Yet the FBI knew there was no protest as early as Sept. 14, according to U.S. officials familiar with the investigation. These people say that?s when FBI agents interviewed four of the five diplomatic security officers who were at the consulate during the attack. The officers were interviewed at Ramstein Airbase in Germany, where they had been evacuated. They told the FBI that there was no protest outside the consulate on 9/11 and that the men who showed up that evening were there to assault the compound.

Information like this ?is ordinarily transferred back to Washington, given to John Brennan in the White House, so the president and White House would be aware of the progress in the investigation,? said Fran Townsend, a former White House homeland security and counterterrorism advisor to President George W. Bush who now serves on the CIA?s external advisory committee.

It?s unclear when the FBI related this information to the White House, and both the FBI and the White House National Security Council declined to comment for this story. Two U.S. intelligence officials, however, say the FBI?s information didn?t make it into the intelligence community databases used by analysts until Sept. 20.

    GOP's McMahon ad targets Conn. Obama voters

    (AP) ? GOP Senate candidate Linda McMahon is courting ticket-splitters in a new ad in which four supporters of President Barack Obama, who has a double-digit lead in the state, say they also will cast ballots for her. Her campaign strongly denied she was writing off Republican presidential hopeful Mitt Romney, saying she supports the former Massachusetts governor "100 percent."

    "Linda McMahon will work with President Obama and I believe he'll work with her," says one of the voters in the ad, David Cole, a disabled veteran who said he plans to vote for the Republican on the independent line in November. McMahon's name will appear as both the Republican and the Independent candidate.

    Nonsense, said Rep. Chris Murphy, the Democrat in the race once thought to have a better shot at winning.

    "This is one of the strangest political ads I have ever seen because we know that Linda McMahon is going to oppose President Obama on everything that he stands for. She's told us that, over and over again," said Murphy, referring to the Republican candidate's calls to repeal and replace Obama's health care legislation and her opposition to his positions on energy reform and tax policy. "I mean, there is almost nothing Linda McMahon agrees with President Obama on, which makes this ad absolutely deceitful."

    It was the latest volley in one of the nation's quirkiest Senate races, one of a series of stubbornly tied contests that have left the national battle for control of the Senate in question. Republicans need to gain three seats, or four if Obama wins. From Massachusetts to Connecticut, Virginia, Indiana, Missouri, Wisconsin, North Dakota, Montana, Nevada and Arizona, contests for Senate are so tight that with two weeks to go, the parties, candidates and outside groups are doling out cash and getting creative about peeling votes away from the other guy.

    With McMahon's ad, Connecticut joins Senate races in which candidates are banking on voters choosing candidates of different parties down the ticket. In places like Montana and North Dakota, the politics are reversed, with Romney expected to win big and Democratic Senate hopefuls making their pitches as independent-minded candidates.

    In Connecticut, the candidates are racing to win the seat of a retiring senator who counted himself an independent: Sen. Joe Lieberman, who caucused with the Democrats.

    The state has a vibrant independent streak. As of last week, the Secretary of the State's Office reported 2 million registered voters in Connecticut, with the largest group, 842,335, being unaffiliated. They are followed by registered Democrats, at 744,729 and registered Republicans at 422,312.

    McMahon's ad rankled Republicans, after they chose the former wrestling empire executive over former Rep. Christopher Shays in the August primary. McMahon lost in 2010 to then-Attorney General Richard Blumenthal after spending more than $50 million of her own money. She has so far personally spent some $27 million on this year's race. State GOP Chairman Jerry Labriola said the Connecticut Republican Party headquarters has been "experiencing very high call volume in response to the ad," with Republican "expressing serious concerns."

    "It's a distressing situation, but we're doing our best to deal with it," he said, adding how he still believes Romney can win in Connecticut and how he's "working very hard to get to elect all Republicans on the top line of the ballot this November."

    McMahon's campaign spokesman, Todd Abrajano, said the campaign has not received a large number of complaints.

    "I think most people realize that in the state of Connecticut, if you're a Republican running statewide, you're going to have to get independents and Democrats to vote for you in order to win," said Abrajano.

    On Wednesday Rajat Gupta will appear in Manhattan federal court to be sentenced for passing secrets he learned, while serving on the board of directors of Goldman Sachs, to Raj Rajaratnam, the former chief of hedge fund giant Galleon Group. Rajaratnam himself was convicted in May 2011 of being the center of the biggest insider trading ring in decades. He?s serving 11 years for his crimes, one of the longest sentences ever for insider trading.

    Like Rajaratnam, Gupta, the former head of McKinsey & Company, deserves punishment. He was convicted of a type of securities fraud, and fraud is a form of theft. He wrongly used his position of power and influence for personal advancement, corroding Main Street?s trust and confidence in Wall Street.?

    Still, Gupta is no Rajaratnam. Gupta tipped inside information about one company to Rajaratnam, while Rajaratnam traded on confidential information collected from many sources. So you?d expect that Gupta would be treated differently when he appears for sentencing. Federal sentencing guidelines, however, suggest a prison term for him that?s similar in length to the 11 years Rajaratnam is serving. And prosecutors want a sentence within those guidelines, just as they want for the hundreds of defendants sentenced in federal courts nationwide every day. Because what Gupta and Rajaratnam did is so different, though, sentencing Gupta to anything like the time Rajaratnam is serving undermines the whole purpose of the sentencing scheme that prosecutors say they want to uphold.

    Lawmakers enacted the federal guidelines in 1987 to try to ensure that defendants who?d committed like crimes received like sentences. They replaced the discretion that judges traditionally enjoyed with a rigid system of mathematical calculations for determining prison term length. Those guidelines were the law of the land until the Supreme Court?s 2005 decision in United States v. Booker, which untethered judges from strict application of the guidelines and returned to them many of the powers that had been wiped away 18 years earlier. Today, the guidelines are advisory, not mandatory.

    Nevertheless, the Department of Justice still believes that the guidelines should be faithfully followed and that judges are wrong to deviate from them. In a 2010 speech to the American Bar Association, Lanny Breuer, assistant attorney general for the DoJ?s Criminal Division, cautioned that the department is ?especially concerned about increased disparity in white-collar sentencing.??In November 2011 Breuer reiterated to another audience that among the ?serious challenges? facing federal sentencing and corrections policy is increased ?disparities in federal sentencing? in recent years. In 2012, the DoJ?s annual report to the United States Sentencing Commission, the independent agency that develops and implements the guidelines, expressed concern about ?continuing erosion of the guidelines,? and said that ?serious reform? of federal sentencing law and policy ?is necessary.?

    Strict application of the guidelines, though, precludes consideration of a whole host of factors relevant to fixing just and appropriate prison terms, like offenders? differing personal histories and their distinctive characteristics. That?s especially unfortunate when it means that the person at the top of a scheme and someone at the bottom end up being sentenced in the same way. Rajaratnam and Gupta provide a perfect example. They both were convicted of insider trading. But while Rajaratnam?s business was trading on inside information, Gupta didn?t buy or sell a single share of stock. Likewise, Rajaratnam made millions, while Gupta didn?t make any money. And Rajaratnam was caught on tape scheming with his co-conspirators. No such recordings of Gupta exist. Still, the former McKinsey chief faces up to 10 years in prison, almost as much time as the former Galleon head is serving.

    Gupta and Rajaratnam are like the kingpin and corner street dealer who do roughly the same amount of time for drug dealing, as happens to a disturbing degree in narcotics cases (which accounted for almost 30 percent ?of the 80,000-plus cases resolved in federal court in 2011). Because drug sentences are fixed by drug type and quantity, not role, defendants in distribution rings face the same potential penalty, whatever their actual position and conduct.? That?s what happened to Jamel Dossie, a small-time, street-level drug dealer?s assistant who was an addict.? In New York in March, he received a five-year mandatory minimum sentence for his role as a go-between in four hand-to-hand crack sales for a total gain to himself of $140.

    Luckily for Rajat Gupta, his sentencing judge is Jed S. Rakoff, who has said that where the federal guidelines ?provide reasonable guidance,? they ?are of considerable help to any judge in fashioning a sentence that is fair, just and reasonable,? but also argued that when the guidelines ?have run so amok that they are patently absurd on their face,? courts should rely more on general sentencing principles. Judge Rakoff faced this dilemma in the case of Richard Adelson, who was convicted of participating in a conspiracy to overstate the financial results of Impath Inc. (a laboratory services company) and artificially inflate its stock price. The guidelines recommended life imprisonment for him, even though other people had concocted and operated the scheme for years before Adelson joined it. Judge Rakoff gave him 42 months, describing the life sentence recommended by the guidelines as ?patently unreasonable.?

    It?s because of Judge Rakoff that Gupta is widely expected to receive a sentence considerably less than what federal guidelines recommend, no matter what the government?s lawyers say. (Gupta?s own counsel have asked for probation.) But the approach of this judge is the exception. The reality of federal sentencing means that it should be closer to the rule.
